Promotions of the Guide for Implementing the Law on Foundations

In cooperation with European Center for Not-for-Profit Law, BCIF has held four promotions of the Guide for Implementing the Law on Foundations during June and July 2011.  The promotions were held in Niš, Kragujevac, Belgrade and Novi Sad.

In November 2010 the new Law on Foundations was passed.  The registration of new foundations, and adjusting the old foundations with the new regulations officially started on March 1st 2011 and it will last for a year.

Balkan Community Initiatives Fund (BCIF)
and European Center for Not-for-Profit Law (ECNL) have been working on the making of the first draft of the Law in cooperation with Ministry of Culture.  With a goal to make it easier for the foundations to adjust their work to the new legal regulative and to properly prepare for the registration process, we have published the Guide for Implementing the Law on Foundations in cooperation with The Serbian Business Registers Agency.  The Guide has been prepared by Dr. Dragan Golubović, Senior Legal Counselor at ECNL, Nives Čulić, Registrar of the Register at The Serbian Business Registers Agency and Jasna Trifunović, Lawyer at Trifunović – Cvetković Law office.

At the promotions in four cities the representatives of Ministry of Culture, Media and Information Society, The Serbian Business Registers Agency and Dr. Dragan Golubović, Legal Counselor have presented the Guide and explained the questions concerned with the new Law, as well as the registration regulations and procedures.  About 120 representatives of foundations had an opportunity to pose concrete questions related to the new legal regulative and registration process.

The Guide answers the questions on how to establish a foundation, questions related to the registration at the Register, organs, foundation’s property and the registration at the register of the foreign foundations’ representative offices and coordinating the Statute and other general acts.  The Guide contains the examples of the Statute concerning a newly-founded foundation, a foundation founded for realizing the common welfare goal, the adjusting of the existing fund and foundation and the adjusting of the already existing foundation.  The Guide contains the text of the Law on Foundations, as well as the appropriate rulebooks.

We believe that the Guide will be of help to foundations and all interested parties to adjust their work to the new legal framework in the fastest and the best manner possible.  Furthermore, we hope that the more auspicious legal regulative will encourage all the people who are willing to work in the fields of foundations and philanthropy, and in that manner assist in reviving philanthropy in Serbia.
